After declaring a public health emergency for the town of Libby, Montana in June of this year, the Environmental Protection Agency (EPA) and the Department of Health and Human Services (HHS) are planning on spending more than $130 million on cleanup efforts and improving the health care system in the area.
To date, approximately 400 Libby residents have passed away from asbestos-related diseases such as malignant mesothelioma. In addition to Libby, the nearby town Troy is also intended to benefit from the public health emergency funds.
Asbestos exposure has affected the area because of W.R. Grace & Company’s nearby toxic vermiculite mine that was contaminated with asbestos. Workers in the mine not only exposed themselves, but family members as well by unknowingly carrying home asbestos fibers on their clothes. Other locations such as fields, roads, playgrounds and gardens were contaminated with asbestos-laced soil as well.
According to the HHS, about 500 people out of the 3,900 that currently live in Libby and Troy have asbestos-related problems. Approximately 50 new cases are reported each year and nearly 2,000 people in Libby have been affected by asbestos since the official closing of the mine in 1990.
While the EPA has had the authority to announce a public health emergency since 1980, the one declared for Libby and Troy is the first of its kind.
The funds for the public health emergency will span over a five-year period with the EPA contributing approximately $125 million. Another $6 million will be spent by the HHS on medical assistance.
The EPA has been working in Libby since 1999, the first year an Emergency Response Team was sent in to investigate the concern over asbestos-contaminated vermiculite. Since that time, the EPA has been working closely with the town to clean up contamination and improve human health.

Widow Speaks of Husband’s Asbestos Death
A woman from the UK has recently spoken out about how she watched her late husband struggle to cope with the asbestos cancer mesothelioma, which is a disease that is caused by exposure to asbestos dust and fibers, and which she said finally took the life of her husband.
Ursula Blewden said that her late husband Frederick used to serve as a soldier for the army, and this is where he was exposed to the potentially deadly substance asbestos, which eventually resulted in him contracting malignant mesothelioma.
Mr Blewden is said to have worked as an engineer for Royal Electrical and Mechanical Engineers from 1941 to 1960, where the exposure is said to have occurred. His widow said: ‘We were just three days from our diamond wedding anniversary when he died. I am very sad he is not here still.’
She added: ‘He lost six stone in seven months. It was so quick. He went from 11 stone to just five stone and he couldn’t support his own weight. He had been very healthy before that. He collapsed on July 14 just outside our bedroom.’

Vermont school district official file asbestos lawsuit
he Montpelier School District has filed an lawsuit against flooring company Morrison-Clark, Inc. The school district hopes to recover damages resulting from the firm’s problematic handling of an asbestos cleanup project last summer at the Main Street Middle School. Asbestos is, by law, meant to be handled and disposed of by licensed professionals. This is because asbestos has the potential to cause serious illnesses, including asbestosis, lung cancer, and pleural mesothelioma.
The district is believed to be seeking damages of at least $88,379.87: the totally amount of fees and costs incurred by the district due to the firm’s mishandling of asbestos. The school was also forced to shut down by the Vermont Department of Health. This forced the school to delay the start of school last year by several days. Asbestos-laden floor tiles were being removed from the school. But according to an attorney for the firm, Morrison-Clark plans to deny any liability.
"There was never any actual asbestos contamination found," Attorney David Bond said Monday. "What did happen was that the state inspector from the Department of Health came to the site and observed activities that he believed to be in violation of the Vermont asbestos control regulations. We disagree with his interpretation."
The suit is based on three counts. The first alleges neglect by Morrison-Clark. The second charge alleges that company broke their contract with the school. The third count alleges consumer fraud by the company, as the company allegedly "engaged in unfair and deceptive acts and practices."

Cooper Industries, Ltd. announced that they will be contributing $130 million and 1.4 million shares of their stock to a trust specifically set up for insurance claims dealing with asbestos poisoning. The company owned Federal Mogul, a car parts company that used asbestos in certain car parts until the damaging effect of the poison was observed.
In a move to prevent bankruptcy and litigation, Cooper Industries, Ltd. started to form a trust in which stock and cash contributions will be allotted for insurance and lawsuit finances. Cooper Ltd. sold the parts company to Federal Mogul, a car parts company which used asbestos in their brake pads and linings. Smaller companies were bought and absorbed by Federal Mogul, implementing the asbestos parts in the production lines of those companies. In the face of multiple lawsuits over the asbestos-filled parts at the acquired companies, Federal Mogul filed bankruptcy in 2001.
The motion states that Federal Mogul, Cooper Industries Ltd. and Abex, a brake making company affiliated with Federal Mogul, will contribute to the trust cash and stock every business quarter. More than 38,000 outstanding claims are still pending against Abex, making Abex a large contributing factor to the 365,000 claims against Federal Mogul. Once the company emerges from their filed bankruptcy, Cooper Ltd. will step in and contribute the first $130 million to the trust. It expects to contribute more than $20 million a year for 25 years in order to facilitate future claims.
A New York based company, M&F Worldwide Corp., will be contributing to the trust as well. M&F is a producer of sweeteners and tobacco additives, but is tied to the lawsuits through their Pneumo Abex LLC unit, which sold the brake company to Cooper Ltd. Their aim is to improve the health, safety and financial well-being of Americans.
Asbestos, a natural mineral that occurs as crystalline or needle-like fibers in rock formations, comes in six different types: actinolite, amosite, anthophyllite, chrysotile, crocidolite and tremolite.
Used regularly until about 1989, when the U.S. Environmental Protection Agency, or EPA, restricted its domestic use to one percent of product by volume, asbestos is known to cause a number of serious diseases, ranging from asbestosis - a debilitating respiratory illness - to lung and digestive tumors, including mesothelioma.
Unlike some other toxins, the human body has no way to rid itself of asbestos fibers. Once inhaled or ingested, they remain in tissue causing irritations, or lesions, that frequently lead to illness.
Mesothelioma, a largely fatal cancer of the mesothelial tissue lining, the lungs and abdomen, tends to lie dormant for decades. By the time it is diagnosed, patients are rarely given more than a year to live, though 10 percent of those affected may survive up to five years.
A 2002 RAND report, which describes asbestos litigation as "...the longest running mass tort in U. S. history", with more than 600,000 individuals suing 6,000 companies (often more than one company per suit) for asbestos-related damages through 2000, has resulted in upward of 60 corporate bankruptcies since 1980, for a total cost of more than $54 billion.
Damages were awarded largely based on what IEHN identifies as eight practices which leave companies liable for product-related injury. These are: shortsightedness; concealed science; disclosing only a minimum of potential liabilities; according privilege in attorney-client relationships to conceal the level of liability; inconsistent estimating liability costs to shareholders; using hidden assumptions to minimize liability estimates; refusing to benchmark liabilities; and refusing to allow stakeholders to question, via annual proxies, the specific risks.
These, says the IEHN, are loopholes the Securities and Exchange Commission (SEC) and the Financial Accounting and Standards Board (FASB) - two entities which regulate corporate risk and financial reporting - need to close to insure that nanotechnology doesn't get itself into the sort of quagmire now faced by former asbestos product manufacturers. In fact, says the IEHN, the loopholes reflect a long-established and pervasive attitude of "don't ask/don't tell" which has already demonstrated it dangers via asbestos litigation and corporate bankruptcies.
In the early 20th century, manufacturers, physicians and workforce managers didn't know the dangers inherent in asbestos. By the time they discovered its destructive capacity, much damage had already been done.
The same is not true of nanotechnology, which has only been around for a decade in commercial use. A recent report out of Europe, by the Agency for Safety and Health at Work (EU-OSHA), puts nanoparticles at the top of the list of substances which could pose new and even greater risks to workers.
